Dear Minister Milloy:

As you know, there has been a long-standing Binding Policy Directive that prohibits public colleges and universities in Ontario from charging "tuition-related" ancillary fees.

However, all 24 of Ontario's community colleges have been charging and are continuing to charge ancillary fees for information technology, libraries, student support or other services that are already covered by tuition fees and capital or operating grants that the provincial government provides.

Even Premier McGuinty, when he was an opposition MPP, correctly identified that "turning a blind-eye" to prohibited ancillary fees is the same as "raising tuition fees through the back door". He also understood that insufficient government funding for post-secondary institutions is the root cause of the reliance on prohibited ancillary fees.

Students should not have to sue their colleges or universities just to be treated fairly. But your government has left them no choice. The Premier identified the problem more than 14 years ago and your government has been in power for more than 4 years. When are you going to take responsibility for this problem and fix it?

I urge you to: stop the prohibited ancillary fees now by enforcing the Binding Policy Directive; commit at least $50 million per year in new government funding to the replace the illegal ancillary fees starting in the 2008 budget; and negotiate a settlement with the current and former students who have been charged the fees that your Ministry explicitly prohibits.
